Overview of the Proposed Landfill Tax Changes
The Government is proposing to remove the lower rate of landfill tax and introduce a single, standardised rate by 2030. As part of these landfill tax reforms, the ‘qualifying fines regime’ will be phased out by 2027, and stricter penalties will be imposed on unauthorised waste operators to deter non-compliance and waste crime.
A new consultation launched by the Treasury said the plans would remove “perverse incentives” created by the “outdated” two-tier system. As a result, the proposed changes would reduce opportunities to misdescribe waste.
The new plans propose an escalation of the lower rate. For inert materials – currently set at £4.05 per tonne this will be until it matches the standard rate, currently £126.15 per tonne. The Govt has recognised that the changes may increase the use of unauthorised landfill or fly-tipping. To deal with this, the Treasury plans to increase the tax rate for illegal deposits.
Now, I am sure you will all have your own views on just how succesful the increase in tax on flytipped material will be, or not. But, the fact that material has been flytipped suggests that the flytippers aren’t really worried about being caught. So why worry about a big bill if they are?
I think that the waste criminals will be rubbing their hands at this new opportunity. Country laybys are about to get even more waste.
But the main impact could be on legal operators, already struggling to deal with trommel fines, as well as changes to Standard Rules permits and waste exemptions.
